1. Provider

The provider of the Affiliate Program is:

2. Subject of the Affiliate Program

The Affiliate Program enables partners worldwide to promote products of Thai Five GmbH through individual affiliate links or personalized voucher codes and receive commissions for successful referrals.

Sales referrals are processed exclusively through the online shop: www.my-thaimassage.shop

3. Eligibility

Participation is limited to natural persons and legal entities of legal age acting as entrepreneurs, self-employed individuals, or business operators.

Affiliates are required to provide complete and accurate information regarding their identity, business, and any tax-related information required.

Thai Five GmbH reserves the right to reject affiliate applications without providing reasons.

4. Tracking, Statistics and Attribution of Sales

Each affiliate partner receives:

- an individual affiliate tracking link,

- and, where applicable, personalized voucher codes.

Sales are recorded exclusively through the tracking system used by Thai Five GmbH and are assigned to the respective affiliate partner accordingly.

Affiliate partners may view their referred sales, commissions and account credits at any time through their user account at www.my-thaimassage.shop.

Commissions can only be granted for orders completed directly through www.my-thaimassage.shop.

Affiliate partners are encouraged to assist their customers throughout the ordering process to ensure correct attribution of sales.

Only the tracking data stored within the systems of Thai Five GmbH shall be considered authoritative for commission attribution.

5. Cookie Duration and Commission Attribution

Sales attribution is based on the most recently valid affiliate tracking record ("Last Click Principle").

The cookie duration is 10 days from the moment a visitor clicks on the affiliate link.

If an order is placed within this period through www.my-thaimassage.shop, the commission will be assigned to the affiliate partner associated with the last recorded click.

6. Voucher Codes and Commission Attribution

Affiliate partners may provide individual voucher codes to their customers.

Voucher codes provided by Thai Five GmbH serve exclusively to identify and attribute orders to the respective affiliate partner.

These voucher codes do not provide percentage-based or fixed-price discounts on products. Instead, customers may receive free promotional items or complimentary gifts when reaching certain order values defined by Thai Five GmbH.

The applicable promotional items, participation conditions and minimum order values are determined by Thai Five GmbH and may be changed at any time.

Orders placed using a voucher code assigned to an affiliate partner will be attributed to that affiliate partner and compensated according to the applicable commission structure.

The use of a voucher code does not affect the agreed commission rate of the affiliate partner.

Publishing voucher codes on coupon websites, cashback portals, discount websites or similar platforms is prohibited unless expressly approved in writing by Thai Five GmbH.

7. Commissions

Affiliate partners receive the following standard commissions on successfully referred and fully paid orders:

10% Commission for products in the following categories:

- Massage Oils

- Herbal Compresses

- Balms & Creams

- Massage Supplies

7% Commission for products in the following category:

- Spa & Studio Equipment

Commissions are earned only for fully completed and paid orders.

Thai Five GmbH reserves the right to modify commission structures and commission rates at any time with future effect.

8. Commission Payments

Commissions are credited monthly to the affiliate partner's account at www.my-thaimassage.shop.

Payouts are made only upon receipt of a valid invoice issued by the affiliate partner in accordance with the tax regulations applicable in the affiliate's country of residence.

The affiliate partner is solely responsible for:

- the proper declaration and taxation of income,

- compliance with national tax regulations,

- and any VAT, sales tax or other tax obligations applicable in their country.

Payout requests are generally processed within 3–5 business days after receipt of the invoice.

Payouts are only possible once a minimum commission balance of EUR 300.00 has been reached.

A maximum of 12 payouts per calendar year is permitted.

Any bank charges, currency conversion fees or payment provider fees shall be borne by the affiliate partner.

9. No Commission Entitlement Exists For

- cancelled or refunded orders,

- withdrawals and revocations,

- payment defaults,

- self-referrals and self-purchases by the affiliate partner,

- orders placed by family members or related parties for the purpose of generating commissions,

- abuse or misuse of the affiliate program,

- violations of these Terms and Conditions,

- sales not correctly tracked due to circumstances beyond the control of Thai Five GmbH,

- fraudulent orders or attempts to manipulate the tracking system.

Commissions are considered finally earned only after expiration of applicable withdrawal periods and after full payment has been received.

10. Advertising Guidelines

The affiliate partner is prohibited from:

- sending spam or unsolicited advertising,

- making misleading or unlawful statements,

- making unauthorized health claims or healing promises,

- infringing trademarks, copyrights or other intellectual property rights of Thai Five GmbH,

- using domains, social media accounts or advertisements containing the name or brand of Thai Five GmbH without prior written permission,

- bidding on protected trademark keywords of Thai Five GmbH in paid advertising campaigns,

- publishing false pricing information or misleading promotional offers.

Affiliate partners must comply with all applicable advertising, competition, data protection and disclosure laws of their respective country.

Promotional content must be clearly identified as advertising or affiliate content whenever required by applicable law.

11. Countries and Territories

Thai Five GmbH may assign non-exclusive focus areas or countries to affiliate partners.

Such assignments do not create any right to exclusivity, territorial protection or exclusive distribution rights.

Thai Five GmbH reserves the right to appoint additional affiliate partners within the same countries or regions at any time.

12. Inactivity and Suspension

Affiliate accounts may be deactivated or deleted by Thai Five GmbH if no activity or referred sales occur within a period of 12 consecutive months.

In the event of violations of these Terms and Conditions, Thai Five GmbH reserves the right to temporarily or permanently suspend affiliate partners and to withhold outstanding commissions in whole or in part.

13. Liability

Thai Five GmbH shall only be liable for intent and gross negligence.

Liability for the following is excluded to the extent permitted by law:

- technical failures,

- tracking errors,

- server outages,

- data loss,

- loss of profits,

- indirect or consequential damages.

14. Changes to the Affiliate Program

Thai Five GmbH reserves the right to modify or discontinue the Affiliate Program, tracking methods, commission structures and these Terms and Conditions at any time with future effect.

15. Final Provisions

The laws of the Federal Republic of Germany shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

To the extent permitted by law, the place of jurisdiction shall be the registered office of Thai Five GmbH.

Thai Five GmbH ขอสงวนสิทธิ์ในการปฏิเสธคำขอสมัครเข้าร่วมโปรแกรมพันธมิตรโดยไม่จำเป็นต้องระบุเหตุผล

4. การติดตาม สถิติ และการระบุยอดขาย

พันธมิตรแต่ละรายจะได้รับ:

- ลิงก์ Affiliate สำหรับการติดตามโดยเฉพาะ

- และในกรณีที่เกี่ยวข้อง รหัสคูปองเฉพาะบุคคล

ยอดขายจะถูกบันทึกและระบุให้กับพันธมิตรที่เกี่ยวข้องผ่านระบบติดตาม (Tracking System) ของ Thai Five GmbH เท่านั้น

พันธมิตรสามารถตรวจสอบยอดขาย ค่าคอมมิชชัน และยอดคงเหลือของตนเองได้ตลอดเวลาผ่านบัญชีผู้ใช้งานบน www.my-thaimassage.shop

ค่าคอมมิชชันจะได้รับการคำนวณเฉพาะสำหรับคำสั่งซื้อที่เสร็จสมบูรณ์ผ่านเว็บไซต์ www.my-thaimassage.shop เท่านั้น

หากมีการสั่งซื้อผ่าน www.my-thaimassage.shop ภายในระยะเวลาดังกล่าว ค่าคอมมิชชันจะถูกระบุให้กับพันธมิตรที่เกี่ยวข้องกับการคลิกล่าสุด

6. รหัสคูปองและการระบุค่าคอมมิชชัน

พันธมิตรสามารถมอบรหัสคูปองเฉพาะบุคคลให้กับลูกค้าได้

รหัสคูปองที่ออกโดย Thai Five GmbH มีวัตถุประสงค์เพื่อใช้ในการระบุและติดตามคำสั่งซื้อให้กับพันธมิตรที่เกี่ยวข้องเท่านั้น

รหัสคูปองดังกล่าวไม่ได้มอบส่วนลดเป็นเปอร์เซ็นต์หรือส่วนลดเป็นจำนวนเงินให้กับสินค้า แต่ลูกค้าอาจได้รับสินค้าส่งเสริมการขายหรือของแถมฟรีเมื่อมียอดสั่งซื้อถึงเกณฑ์ขั้นต่ำที่ Thai Five GmbH กำหนด

รายการสินค้าส่งเสริมการขาย เงื่อนไขการเข้าร่วม และยอดสั่งซื้อขั้นต่ำ สามารถกำหนดและเปลี่ยนแปลงได้โดย Thai Five GmbH ตามดุลยพินิจของบริษัท

7. ค่าคอมมิชชัน

พันธมิตรจะได้รับค่าคอมมิชชันสำหรับคำสั่งซื้อที่สมบูรณ์และได้รับการชำระเงินเรียบร้อยแล้ว ดังนี้:

ค่าคอมมิชชัน 10% สำหรับสินค้าประเภท:

- น้ำมันนวด

- ลูกประคบสมุนไพร

- บาล์มและครีม

- อุปกรณ์และวัสดุสำหรับการนวด

ค่าคอมมิชชัน 7% สำหรับสินค้าประเภท:

- อุปกรณ์สำหรับสปาและร้านนวด

ค่าคอมมิชชันจะเกิดขึ้นเฉพาะสำหรับคำสั่งซื้อที่เสร็จสมบูรณ์และได้รับการชำระเงินเต็มจำนวนแล้วเท่านั้น

Thai Five GmbH ขอสงวนสิทธิ์ในการเปลี่ยนแปลงโครงสร้างและอัตราค่าคอมมิชชันในอนาคตได้ทุกเมื่อ

8. การจ่ายค่าคอมมิชชัน

ค่าคอมมิชชันจะถูกบันทึกเข้าบัญชีพันธมิตรบน www.my-thaimassage.shop เป็นรายเดือน

การจ่ายเงินจะดำเนินการเมื่อได้รับใบแจ้งหนี้ที่ถูกต้องตามกฎหมายจากพันธมิตร และเป็นไปตามข้อกำหนดทางภาษีของประเทศที่พันธมิตรพำนักอยู่

พันธมิตรเป็นผู้รับผิดชอบแต่เพียงผู้เดียวในเรื่อง:

- การยื่นและชำระภาษีรายได้ของตนเอง

- การปฏิบัติตามกฎหมายภาษีของประเทศตน

- ภาษีมูลค่าเพิ่ม (VAT) หรือภาษีอื่น ๆ ที่เกี่ยวข้อง

โดยปกติคำขอรับเงินจะได้รับการดำเนินการภายใน 3–5 วันทำการหลังจากได้รับใบแจ้งหนี้

สามารถขอรับเงินได้เมื่อมียอดค่าคอมมิชชันสะสมขั้นต่ำ 300.00 ยูโร

จำกัดการจ่ายเงินสูงสุด 12 ครั้งต่อปีปฏิทิน

ค่าธรรมเนียมธนาคาร ค่าธรรมเนียมแลกเปลี่ยนสกุลเงิน หรือค่าธรรมเนียมผู้ให้บริการชำระเงิน เป็นความรับผิดชอบของพันธมิตร

9. กรณีที่ไม่มีสิทธิได้รับค่าคอมมิชชัน

- คำสั่งซื้อที่ถูกยกเลิกหรือคืนเงิน

- การใช้สิทธิยกเลิกการซื้อสินค้า

- การไม่ชำระเงินของลูกค้า

- การสั่งซื้อโดยพันธมิตรเอง

- การสั่งซื้อโดยสมาชิกครอบครัวหรือบุคคลที่เกี่ยวข้องเพื่อสร้างค่าคอมมิชชัน

- การใช้โปรแกรมในทางที่ผิด

- การละเมิดข้อกำหนดและเงื่อนไขนี้

- ยอดขายที่ไม่สามารถบันทึกได้อย่างถูกต้องจากเหตุที่อยู่นอกเหนือการควบคุมของ Thai Five GmbH

- คำสั่งซื้อที่เป็นการฉ้อโกงหรือพยายามแทรกแซงระบบติดตาม

ค่าคอมมิชชันจะถือว่าได้รับอย่างสมบูรณ์ต่อเมื่อพ้นระยะเวลาการยกเลิกตามกฎหมายและได้รับชำระเงินครบถ้วนแล้ว

10. หลักเกณฑ์ด้านการโฆษณา

ห้ามพันธมิตร:

- ส่งสแปมหรือโฆษณาที่ไม่ได้รับการร้องขอ

- ให้ข้อมูลที่ทำให้เข้าใจผิดหรือผิดกฎหมาย

- กล่าวอ้างสรรพคุณทางสุขภาพหรือการรักษาที่ไม่ได้รับอนุญาต

- ละเมิดเครื่องหมายการค้า ลิขสิทธิ์ หรือทรัพย์สินทางปัญญาของ Thai Five GmbH

- ใช้ชื่อแบรนด์หรือชื่อบริษัทในโดเมน บัญชีโซเชียลมีเดีย หรือโฆษณา โดยไม่ได้รับอนุญาตเป็นลายลักษณ์อักษร

- ประมูลคีย์เวิร์ดโฆษณาที่เป็นเครื่องหมายการค้าของ Thai Five GmbH

- เผยแพร่ข้อมูลราคาที่ไม่ถูกต้องหรือโปรโมชั่นที่ทำให้เข้าใจผิด

พันธมิตรต้องปฏิบัติตามกฎหมายเกี่ยวกับการโฆษณา การแข่งขัน การคุ้มครองข้อมูลส่วนบุคคล และข้อกำหนดด้านการเปิดเผยข้อมูลที่ใช้บังคับในประเทศของตน

เนื้อหาเพื่อการส่งเสริมการขายจะต้องระบุอย่างชัดเจนว่าเป็นโฆษณาหรือเนื้อหา Affiliate หากกฎหมายกำหนดไว้

11. ประเทศและพื้นที่ดำเนินงาน

Thai Five GmbH อาจกำหนดประเทศหรือพื้นที่เป้าหมายให้กับพันธมิตรบางรายในลักษณะที่ไม่ผูกขาด

การกำหนดดังกล่าวไม่ได้ก่อให้เกิดสิทธิ์ผูกขาด สิทธิ์คุ้มครองพื้นที่ หรือสิทธิ์การจัดจำหน่ายแต่เพียงผู้เดียว

Thai Five GmbH ขอสงวนสิทธิ์ในการแต่งตั้งพันธมิตรเพิ่มเติมในประเทศหรือภูมิภาคเดียวกันได้ทุกเมื่อ

12. การไม่มีความเคลื่อนไหวและการระงับบัญชี

บัญชี Affiliate อาจถูกปิดใช้งานหรือลบ หากไม่มีการใช้งานหรือไม่มียอดขายที่เกิดจากพันธมิตรเป็นระยะเวลา 12 เดือนติดต่อกัน

ในกรณีที่มีการละเมิดข้อกำหนดและเงื่อนไข Thai Five GmbH ขอสงวนสิทธิ์ในการระงับบัญชีชั่วคราวหรือถาวร และระงับการจ่ายค่าคอมมิชชันที่ค้างชำระทั้งหมดหรือบางส่วน

13. ความรับผิด

Thai Five GmbH จะรับผิดเฉพาะในกรณีที่เกิดจากเจตนาหรือความประมาทเลินเล่ออย่างร้ายแรงเท่านั้น

ในขอบเขตที่กฎหมายอนุญาต บริษัทจะไม่รับผิดชอบต่อ:

- ความขัดข้องทางเทคนิค

- ข้อผิดพลาดของระบบติดตาม

- การหยุดทำงานของเซิร์ฟเวอร์

- การสูญหายของข้อมูล

- การสูญเสียกำไร

- ความเสียหายทางอ้อมหรือความเสียหายที่ตามมา

14. การเปลี่ยนแปลงโปรแกรมพันธมิตร

Thai Five GmbH ขอสงวนสิทธิ์ในการแก้ไข เปลี่ยนแปลง หรือยุติโปรแกรมพันธมิตร วิธีการติดตาม โครงสร้างค่าคอมมิชชัน และข้อกำหนดเหล่านี้ได้ทุกเมื่อ โดยมีผลในอนาคต

15. ข้อกำหนดสุดท้าย

ให้ใช้กฎหมายของสหพันธ์สาธารณรัฐเยอรมนี โดยไม่รวมอนุสัญญาสหประชาชาติว่าด้วยสัญญาซื้อขายสินค้าระหว่างประเทศ (CISG)

เท่าที่กฎหมายอนุญาต ศาลที่มีเขตอำนาจคือศาล ณ ที่ตั้งสำนักงานใหญ่ของ Thai Five GmbH
